Unit Owner Complaint Letter

TOWNHOUSES AT JACARANDA…AN OWNER’S NIGHTMARE!
Where are the laws of this great country? I am sure they exist as they are listed in the Constitution. The United States prides itself on having the best legal system in the world…with Liberty, the right to live and the freedom of speech.

Five years ago, I bought my property here in TAJ. I was investigated, a background screening was done, and I had to wait for the Board to “approve” me as the buyer of the property. All so that I could live here in “paradise”!!! Nowadays, anyone can buy property here and rent out immediately. The Board does not even care. I have proof of townhouses where over 10 renters are occupying one townhouse!!!

Unfortunately, there is another type of government in this community, one that resembles a Third World anarchy, where citizens do not have rights, only those who govern, where a small group makes up laws and dispense of our properties at their will.

Our neighbors, cooperative, nice people, turn into something totally different once they get on the Board of Directors. They become almighty and aim to bankrupt us all. If any of the homeowners fall behind in their maintenance dues a couple of months, they immediately put a lien on their property. They have created exorbitant Special Assessments due to their dealings without the approval or consultation of the homeowners. Such as the purchase of two townhouses the Board purchased and now we all have to pay the consequences of their mistakes. I don’t have the right words to describe them: thieves, rats, crooks or worse…It seems they have some personal gain in this. What they did is criminal…they should be prosecuted to the full extent of the law.

Worse yet, these “directors” have an inept and evil ally in Beth Lindie, their attorney. This woman places liens on properties without investigating if the homeowner indeed owes what he is accused of. She puts homeowners into fear of foreclosure by threatening them with a 10 day warning or a lien placed on their property, then within 7 days, the lien is already placed on the property.

The Board, not happy with having an inept attorney, they also have the worst management...a company so poorly
run that they fail to record payments made so no one knows who has made payments and who hasn’t. This group reports erroneous information to the Board and to the attorney, they don’t post maintenance payments accurately, therefore, we are all in jeopardy of losing our properties.

So now, aside from having to live in this community where nothing is working (sprinklers, landscaping, etc), we have to tolerate burglaries, drugs and gangs. And, worst of all, a complete useless maintenance and office crew. Yes, you have read it right, USELESS. They are inept and inefficient and we continue to pay for their salaries. If you don’t believe it, take a look at the tennis courts or the playground and see for yourselves.

We are being robbed openly and brazenly and no one speaks up, we just quietly pay what we owe so our properties won’t be taken from us by the almighty Board!!!

I propose to the new Board that before you implement your fabulous ideas that have cost us a fortune, please start by:

Replace the current attorney.

Hire a professional maintenance crew, not golf cart “pilots”, which is what we now have.

Replace the two office employees, or keep just one of them which is enough. This person needs to be bilingual Spanish speaking. We have a great number of homeowners who cannot communicate well in English, thus they avoid going to the office to voice a complaint. (BOD just hired another one, WHY????????????????)

Install surveillance cameras ASAP. (Pools, Tennis Court & Playground)

Hello Lue - Well It is now 9/1 and although I dont expect you to be in the office I would have expected some results from the prior emails. As of yet I have not heard from anyone and the over spray is still all over the back of my patio, doors, fence, furniture, etc. No one has called or email me to arrange a resolution.
Can you please tell me when I might expect something from the association and the painters?

Dear Association:
It would have been nice for the association to have even acknowleged receipt of the previous email with some sort of timeline as to a follow up. But to have received no notice or email whatsoever is beyond words.
How long does it take for you to respond to homeowner complaints?

Unit 2703 Complaint

To Townhomes of Jacaranda Office/Board Directors
Please be advised that I have noticed a large amount of overspray of paint from the building behind me onto my unit - 2703 ... my sliding glass door, my fence, patio, patio contents. I would like this corrected as soon as possible at no cost to be as this was not caused by me but caused by the painters while painting the building next to mine.
