BOD Meeting April 14th, 2008: Briefly

Una traducción española está disponible en Web site: www.TAJWatchSpanish.blogspot.com

(This is an abbreviated report. More news will follow when more time is available.)

Vacancy Replacement Election
Augusta Alvarez has resigned from the BOD for personal reasons. Esther Leacock has withdrawn her candidacy for the BOD. The three remaining candidates (Dan Capobianco, Mark Morgenstern, and Dan Vermut) will be appointed to the BOD to fill the three vacancies without an association election.

Bob Allen Lawsuit Settlement
The settlement in TAJ's favor is to be divided between three buildings as follows, approximately:
Bldg 12 = $14,300; Bldg 13 = $17,600; Bldg 18 = $4,200. Before distribution of the funds, past-due accounts are going to be considered.

Maintenance
Our maintenance crew is going to be cleaning the rain gutters.

TAJ Owned Units
WH is donating her real-estate expertise to sell the vacant unit (3602) without taking a commission so that the Association can avoid further debt. First payment comes due June 2008.

Construction Committee
Paulette Watson is the new chairman. She is joined by several men in the community (names unknown as of yet).

Paulette said, bldg 14 should expect to pay additional $440.00/unit for roofing expenses. They should expect to pay approx $10,000/unit in additional expense due to construction change orders. The project has apparently already gone through contingency some time ago.

Seeking new contractors at this time. Also seeking to work things out with JM and Needham. Apparently both have let permits expire.

Financial Matters
Yvonne has apparently been spending many hours of her personal time in meetings with bank officer and accounting firm. She has found accounting firm to be too small to accommodate our needs, and the BOD is seeking to replace them. They are seeking progressive changes, such as faster response from accountants, ability to pay fees online and with credit cards, etc.

Yvonne also stated the expectation that the Bank Officer will re-negotiate the existing bank loans to reduce the interest rates and apply a forgiveness of interest debt already accrued. She also expressed a desire to accommodate unit owners who are struggling to make payments by accepting partial payments and perhaps setting up payment plans. She also indicated an aggressive stance toward those unit owners who do not pay their monthly maintenance and thereby put the burden of payment onto their neighbors.

BOD has resolved to hire a Forensic Accounting firm. (crowd cheered!)

Attorney
Officers stated a desire to hire an additional attorney to assist the BOD in their legal matters. B Lindie will also remain the Association attorney.

FAQs
A number of disgruntled unit owners (there were about thirty in attendance) asked questions and shared their opinions and concerns. Some of the questions that were asked are frequently asked and answered questions:

Does the BOD have the authority to buy units? yes

Why can't we use money that has been set aside in association reserve accounts to pay for our building refurbishments?
Because it is against Florida State law to spend reserve money on anything other than for what it is reserved.

Why would the BOD not accept partial payment on delinquent accounts?
The TAJ office does not ever accept payments so that they are never in the position of handling the money. Also, once the attorney gets involved (due to a delinquency being reported by the accountant to the attorney), the attorney has control over the account and not the BOD. Also, the BOD is bound by law to treat everyone the same -- allowing one or some to make partial payments means that they must allow all to do the same. Failure to do so is called selective enforcement of the rules and can leave the BOD vulnerable to a law suit.
